General Terms and Conditions
These General Terms and Conditions ("Terms") apply to all services provided by "778mobile GmbH" ("Provider", "we", "us") via its websites and mobile portals, including but not limited to "Docufy" (the "Service").
By subscribing to, accessing, or using the Service, you agree to be bound by these Terms.
1. Scope of Application
1.1. These Terms govern all contractual relationships between the Provider and consumers ("User", "you") who access or use the Service.
1.2. The Service consists of a digital entertainment subscription offering access to games, a daily horoscope, fitness content and exclusive deals via the User's mobile device.
1.3. These Terms apply exclusively to users in Oman.
1.4. The Provider provides its services exclusively on the basis of these Terms. By using the Service, the User accepts these Terms as binding.
2. Formation of Contract
2.1. The presentation of services on the website does not constitute a binding offer by the Provider, but merely an invitation for the User to submit an offer.
2.2. A contract is concluded when the User subscribes to the Service by following the on-screen instructions and confirming the subscription via their mobile device.
2.3. Immediately after activation, the User may access and use all services offered on the website via their mobile device.
3. Pricing and Payment
3.1. The Service costs OMR 0.315 per day with auto-renewal. 5% VAT is inclusive. Prices apply for the stated period and relate solely to the granting of the right to use the Provider's services.
3.2. Prices do not include any data or connectivity charges that may be levied by the User's mobile operator.
3.3. Charges are deducted directly from the User's Ooredoo balance as part of standard billing.
4. Usage Rights
4.1. The Provider grants the User a simple, non-transferable, geographically unrestricted right to use the Service for the duration of the contract.
5. Cancellation and Unsubscription
5.1. The User may cancel the subscription at any time by sending UNSUB DTD to 92562.
5.2. Cancellation takes effect at the end of the current billing day. No refunds are granted for unused periods unless required by law.
6. Availability
6.1. The Provider guarantees service availability of 99.5% on an annual average. If this availability is not achieved, the User may claim a price reduction limited to the amount paid during the unavailability period.
6.2. The Provider cannot guarantee that the Service can be accessed on all mobile devices available on the market.
7. Limitation of Liability
7.1. The Provider is only liable for damages other than those caused by injury to life, body or health if they are based on intentional or grossly negligent conduct by the Provider, its employees or agents.
7.2. To the maximum extent permitted by law, liability for indirect or consequential damages, including loss of data or profits, is excluded.
8. Age Restriction
8.1. To make use of the Service, the User must be more than 18 years old or have permission from a parent or the person authorised to pay the bill of the mobile number used.
9. Data Protection
9.1. Personal data is processed in accordance with applicable data protection laws.
9.2. Details on data processing, purposes and user rights are described in the separate Privacy Policy, which forms an integral part of these Terms.
10. Amendments
10.1. The Provider reserves the right to amend these Terms at any time. The most recent version will always be available on the website.
11. Governing Law
11.1. These Terms are governed by applicable law. Mandatory consumer protection laws of the User's country of residence remain unaffected.
